By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

HavenDuskTide offers an array of top-tier yacht charter services, which include but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All services are contingent on availability and weather conditions. We retain the right to amend or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

  • Be no less than 18 years of age
  • Provide accurate and complete personal information
  • Remit the required deposit as specified in your booking acknowledgment
  • Consent to these Terms & Conditions

3.2 Confirmation

A charter is considered confirmed only once payment is received and you are provided with our written confirmation. We retain the discretion to deny service to any individual.

3.3 Availability

Charter reservations are dependent on vessel availability and adequate weather conditions. We will strive to honor your preferred dates and times as best as we can.

4. Payment Terms

4.1 Pricing

Prices are given in € and are inclusive of all applicable taxes unless specified otherwise. Prices may vary and are subject to change without any notice.

4.2 Payment Schedule

  • Deposit: 50% of the total charter fee is due at the time of booking
  • Final Payment: Due 48 hours prior to the charter's departure
  • Incidental charges (if applicable): Due upon the charter's completion

4.3 Payment Methods

We accept a variety of payment methods including major credit cards, bank transfers, and certified cheques. All payments are processed using secure, encrypted technology.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund less any processing fees
  • Between 24 to 72 hours before departure: 50% refund
  • Less than 24 hours before the departure: No refund

5.2 Weather Cancellations

In the event our captain determines weather conditions unsafe, we will propose to either:

  • Postpone your charter to an upcoming available date without any added fees
  • Issue a full refund if rescheduling is not feasible

5.3 Mechanical Failures

Should there be any mechanical issues with the vessel designated for your charter, we will aim to supply a comparable substitute. If no such vessel is available, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Regulations

All guests are expected to:

  • Follow instructions from the crew
  • Utilize safety gear as needed
  • Disclose any medical conditions that could affect their safety
  • Stay within demarcated areas on the vessel

6.2 Prohibited Items

The following items are not allowed on board:

  • Glass containers
  • Illegal products
  • Weapons or firearms
  • Excessive beverages (beyond moderate consumption)
  • Pets (unless authorization is granted beforehand)

6.3 Behavior

Passengers must maintain a considerate and respectful demeanor. A charter may be terminated prematurely and without refund if passenger behavior constitutes a danger or interrupts the enjoyment of others.

7. Liability and Insurance

7.1 Our Liability

Our liability shall be confined to the sum paid for your charter. We will not be held accountable for:

  • Injuries incurred due to passenger negligence
  • Theft or damage to personal belongings
  • Indirect or punitive damages
  • Delays due to weather or circumstances not in our control

7.2 Insurance Details

Our operations and vessels are covered under comprehensive marine insurance. Passengers ought to arrange their own personal and travel insurance.

7.3 Risk Acceptance

You recognize that maritime undertakings inherently carry risks and you accept responsibility for your personal safety and well-being by taking part in our charter services.

8. Itinerary and Schedule Adjustments

We have the right to change itineraries, routes, or schedules owing to weather, safety, or operational needs. We will endeavor to offer comparable alternative activities whenever possible.

9. Unforeseeable Events

We shall not be accountable for any delay, alteration, or cancellation induced by events outside our reasonable control, which include but are not restricted to:

  • Extreme weather
  • Natural disasters
  • Regulatory actions
  • Port closures
  • Mechanical breakdowns
